Contracts, Terms and Conditions with Alan Sargent - 24 September 2019 - £57 + processing fee
Contracts, Terms and Conditions with Alan Sargent - 24 September 2019 - £57 + processing fee
Alan Sargent is the founder of The Association of Professional Landscapers and The Professional Garden Consultants Association and a visiting Management Lecturer at Kew Gardens (Final Year Kew Diploma). He is an award winning columnist for The Horticulture Week and contributor to The Professional Gardener and Expert Witness Journal magazines. He also the author of The Landscapers Survival Manual and a Fellow of The Chartered Institute of Horticulture. He is called upon to be an expert witness and is a consultant to various property and commercial clients including the Cadogan Estate, Harrow Boys School, Eton College, Savills (London), Knight Frank (London) and Oxford University.
During this workshop, Alan will examine a selection of genuine cases, involving projects that have failed through lack of detailed specification, attention to detail in quoting and terms and conditions of contract. He will also look at redacted cases, including history and recounting step by step how these projects played out through the Courts, results and ramifications of Legal Action.
Relying on Standard Terms & Conditions for all projects can produce many problems, unless a more bespoke system is available and in place. He will look at Variation Orders, plus Alterations and Additions to an original quotation which can negate or change the nature of that document.
This workshop will guide you through the perils and pitfalls of producing bespoke contracts for domestic Designers and Design and Build Contractors.
Alan will introduce his methods of ensuring that the customer is completely at ease with a project, working with the designer in the first instance, introducing Contract (Design Management) 2015 as an integral element of the Contract.
He will explain how he separates Terms from Conditions, creating Contracts that include Method Statements, CDM and Conditions that are underpinned by Terms.
This technique enables Designers (and Design & Build Contractors) to control both the project and the client from Initial Survey to Practical Substantial Completion and beyond as a way of marketing and selling your services.
